Do you need a witness or witnesses for your second request - the written declaration?
The second request for voluntary assisted dying needs to be made by a formal declaration, stating that your request for access to VAD is being made voluntarily and without coercion and that you understand its nature and effect.
You need to sign this declaration in the presence of two witnesses, both of whom declare that they are not knowingly an ineligible witness and that you appeared to freely and voluntarily sign the declaration.
An 'ineligible witness' is someone who:
- is under 18 years of age;
- knows or believes that they are a beneficiary under your will;
- knows or believes that they may otherwise benefit financially or in any other material way from your death;
- is a family member;
- is your coordinating practitioner.
